Проблема відмежування кримінального аборту від умисного вбивства
Abstract
The author gives some propositions concerning the prohibition of artificial abortion with the term over 22 weeks of pregnancy (except the cases of extra necessity); the qualification as the murder the cases when in result of premature birth (after 22 weeks of pregnancy) the alive baby is extracted and will be deprived of life in future: the author also gives the recommendations concerning the changes of the disposition of the article 134 of the Criminal Code of Ukraine.
