REGULATORY AND LEGAL SUPPORT OF EDUCATIONAL FUNCTIONS IN MODERN UKRAINE

Abstract

The article examines the tort issues related to the regulatory and legal support of educational processes by state bodies in modern Ukraine. It emphasizes the existence of those measures that are regulated by the system of state bodies and ensure the dynamic development of education, its implementation at various educational levels. Special attention deserves the coverage of the issues of the peculiarities of the trends in the practical implementation of issues related to ensuring high-quality education for citizens and guaranteeing by the state of regulatory and legal mechanisms for providing educational functions in modern Ukraine. Special attention is paid to the implementation of proposals aimed at accumulating the experience of European standards in the educational process regarding innovative multi-faceted approaches in the system of administrative and legal regulation of the educational sphere of our state. Actual issues of regulatory and legal support for the education of young people with special needs are gaining practical importance. In the modern globalized world, the issue of defining human rights and freedoms is becoming more relevant, and, undoubtedly, a significant stage in the development of our rule of law state was the updating of legislation with the provisions of the Law of Ukraine of September 5, 2017 “On Education”. One of the decisive steps in this direction to ensure the development of programmatic learning and significant changes in the situational order was the absolutely necessary provisions defined by the orders of the Ministry of Education and Science of Ukraine on the issues of staffing of educational institutions. At the same time, despite the potential focus of the target designation on issues of the system of a number of regulatory legal acts regulating existing norms and a set of services and measures guaranteeing the management of the educational process, it is worth noting the practical absence of a legislative act providing for the tort direction of legal norms in the system of key issues of individual certainty of conditionality offered to society and young people receiving education.
