INFORMATION OF THE PROSECUTOR’S OFFICE: ISSUES OF LEGAL NATURE, CLASSIFICATION AND IMPLEMENTATION OF POWERS TO WORK WITH INFORMATION

Abstract

The article provides theoretical substantiation of the information provision of the directions of the work of the prosecutor and the prosecutor’s offices of Ukraine by defining the legal nature, role and sources of obtaining information in the procedural and managerial activities of the prosecutor, as well as the peculiarities of the influence of objects of information relations on the results of prosecutorial activities.

The author focuses on the transition to electronic document circulation, the expansion of technology processing and analysis of information by the prosecutor’s office.

In general, the article provides a theoretical substantiation of “prosecutorial information” as an element of information provision of the directions of the work of the prosecutor and the prosecutor’s office of Ukraine. The legal nature of the types of information used in the work of the prosecutor’s office and its role in the work of the prosecutor’s office is determined. At the same time, the peculiarities of the influence of information and information legal relations on the results of prosecutorial activities are considered.

The factors of influence of information processes, information technologies and dynamics of creation of information and its exchange on the functional activity of the public prosecutor as a public figure in the information-legal state are distinguished. Usually due to information leakage, the results of the activities of the prosecutor’s office fall into the field of civil society and are sources of criticism of the work of the prosecutor’s office.

The thesis is based on the fact that the special nature of the informational status of the prosecutor is correlated with the information with which the prosecutor works, which distinguishes him from other categories of public persons.

It is proved that the statutory regulatory powers affect the scope and types of information that prosecutors work because they directly envisage the possibility of joining a certain information process or the availability of certain information. The manifestations of the “information and legal component” in the Law of Ukraine “On the Prosecutor’s Office” were determined and the role of information as a category of information law was established in the course of reaching the tasks of the prosecutor’s office.
