DONATION IS AN INTEGRAL COMPONENT OF ENSURING THE EXERCISE OF THE RIGHT TO MEDICAL CARE WITH THE APPLICATION OF TRANSPLANTATION

Abstract

The article examines an integral part of ensuring the implementation of the constitutional right to medical care with the use of transplantation of human anatomical materials – donation of organs and other human tissues. The article analyzes the concept of donation, which is a prerequisite for the implementation of the constitutional right to medical care using transplantation, as well as the classification of donation into lifelong donation and posthumous donation. Full human life is not possible without a high level of health, without the normal functioning of organs and systems of the human body. In the conditions of building a legal, democratic state, the central and key element of the legal system of our state is the provision and guarantee of human and civil rights and freedoms. At the present stage of development, medicine is able to provide care to patients who need to replace certain organs or tissues through the use of transplantation. The constitutional human right to medical care through transplantation occupies an important place in the system of realization of constitutional rights. An important factor in ensuring the human right to medical care through transplantation is a clear definition of donation, as well as ensuring the rights and responsibilities of the donor. Donation and transplantation have emerged in society as a result of health needs. Surgical intervention with the use of transplantation is a rather complicated procedure, and therefore the quality of the operation depends on both the life of the recipient and the life of the donor. Medical care with the use of transplantation of human anatomical materials should be provided qualitatively and in full. The normative base of the research is presented by the national and foreign legislation concerning the issue of donation of human anatomical materials to ensure the realization of the constitutional right to medical care with the use of transplantation.
