PUNISHMENT IN INTERNATIONAL CRIMINAL LAW: MAPPING THE CHALLENGES TO THE CONCEPTUALISATION OF THE NOTION

The article is devoted to the study of problematique of the conceptualisation of the notion of punishment in international criminal law and identification of the challenges that currently exist on the way to the relevant result. The role and place of the phenomenon of “international crime” in this process, as such, which not only permeates the vast majority of aspects of international criminal law, but also is in close connection with “punishment”, significantly influencing it, modifying its internal substantive characteristics and parameters are determined. Two groups of current challenges to the conceptualisation of punishment in international criminal law, among which, on the one hand, the dominant place is occupied by the issues of “authority” and “legitimacy” of international criminal law, “legality” and “legitimation” of international criminal courts and tribunals, as well as the “legitimacy” of punishment in international criminal law (“external challenges”), and on the other – a wide range of problems related to the definition of punishment, its purpose, goals, structure of the system of punishments, specific types of punishment, as well as other specific nuances centred around this category (“internal challenges”) are identified and systematized. The prospects of the topic of study and the expediency of its further scientific development in view of the identified emerging trends (“derivative nature“, “selectivity”, “confrontation”) are emphasized and substantiated.
