STATE POLICY IN THE FIELD OF LEGAL EXPERT ACTIVITY AS AN ELEMENT OF THE OBJECT OF THE THEORY OF LEGAL EXAMINATION

The article provides the analyses of the traditional approach’s shortcomings to the assessment of forensic activities. One of the national shortcomings, in the author’s opinion, is that significant patterns of the state policy implementation in the field of forensic activities fall out of the field of cognition. It is noted that although the theory of forensic examination is a young branch of scientific knowledge and does not even have a final name, there is a general tendency to isolate scientific knowledge in the field of forensic examination regardless of national scientific traditions and accepted terminology. One may observe an increasing interest in this field of science in the Republic of Belarus. This is largely due to the implementation in Belarus of a centralized model of forensic activities and the formulation of public policy in the field of forensic activities as an independent sphere of state policy. The author ascertains the shortcomings of forensic examination theory, which manifested itself in the fact that issues of organizational and legal support of forensic activities have been neglected. The above mentioned issues did not find their place as a part of the theory. The author believes that this is a consequence of the forensic activities’ theoretical model shortcomings within the theory of forensic examination. The philosophy of the object’s cognition theory does not include an analysis of the public policy in the field of forensic activities. The article analyzes the concept of forensic activities’ “blocks” proposed by M.Ya. Segay. The author highlights the breakthrough nature of this concept. At the same time he points out its lack of universality and consistency. The author proposes an alternative in the form of the forensic activities’ levels analysis. Three levels of forensic activities (an examiner’s activity, examiners organization activities, public policy in the field of forensic activities) fully cover all the significant aspects of forensic activities and ensure their systematic presentation.
