ADMINISTRATIVE AND LEGAL FOUNDATIONS OF THE FUNCTIONING OF THE SYSTEM OF SUBJECTS OF JUVENILE JUSTICE IN THE FIELD OF ENSURING CHILDREN’S RIGHTS

Abstract

The system of subjects and legal foundations of their activity is an integral component of the administrative and legal mechanism of functioning of juvenile justice, through which the actual realization of the tasks of the state and society in ensuring the rights of the child in the said sphere of social relations is carried out. Scientific searches for effective and optimal models of the structure of juvenile justice subjects and their functioning were carried out by: O. Yarmots, K. Smelovtsev, E. Nedzinskas and A. Janushauskas, S. Povolotska, P. Raynor and G. McIvor, T. Chapman, D. O’Mahony, R. Deazley and other scientists. The purpose of the study is to form an idea of the prospects for further reforming the model of the juvenile justice system in Ukraine and to determine the administrative and legal foundations for organizing the activities of its new (potential) entities. One of the drawbacks of the administrative and legal regulation of juvenile justice in Ukraine is the lack of a normative definition of the consolidated structure of the subjects of this system. It has been found that the creation of an effective model of juvenile justice requires the transformation of existing or new entities, as well as the establishment of interaction and coordination between the entities of this system. The experience of the organization https//orcid. of public administration bodies conducting management, consulting, interaction, scientific and methodological support and practical realization of functions of juvenile justice in the USA, Great Britain, Republic of Belarus, Georgia, etc. was analyzed. The Ukrainian model of the juvenile justice system is presented, which in the future is proposed to be supplemented by such bodies as: The Ukrainian Parliament Commissioner for Children’s Rights, the Coordination Center of Juvenile Justice and Delinquency Prevention, the territorial coordination councils on juvenile justice, the multidisciplinary juvenile teams, the community prevention centers, children’s centers for socialization, and reform the Interagency Coordination Council for Juvenile Justice and Juvenile Police.
