PRESERVATION OF INTELLECTUAL PROPERTY IN THE CONTEXT OF RUSSIAN ARMED AGGRESSION

Abstract

Abstract. The Russian armed aggression has led to significant challenges of a complex nature at both the macro and micro levels. One of these challenges is the threat to intellectual property in Ukraine. The purpose of the article is to identify the peculiarities and current challenges to the preservation of intellectual property in the context of Russia’s hybrid approaches in its armed aggression against Ukraine. The article examines the current issues of intellectual property in Ukraine and the newest challenges that have arisen against the background of the Russian armed aggression in February 2022. It is emphasized that the hybridism of Russian armed aggression has led to both an aggravation of the problems that previously existed in the field of intellectual property in Ukraine and created significantly new threats in this area. The authors describe the chronology of the situation with intellectual property protection in Ukraine at the beginning of a new stage of Russian armed aggression in February 2022. The key challenges faced by the Ukrainian professional community and institutions in the field of intellectual property are highlighted. The authors analyze recent changes in the legislative framework in the context of intellectual property preservation. A set of recommendations for the preservation of intellectual property, consisting of the areas of harmonization of the regulatory framework and digitalization of the interaction of the Ukrainian Institute of Intellectual Property with stakeholders, was formed. Additionally, this set of measures provides for the development and implementation of an adequate procedure for working with intellectual property rights holders and applicants who do not reside in Ukraine, as well as the development of a system of communication with stakeholders. This study may be useful for specialized researchers, experts in the field of intellectual property, Ukrainian and foreign businesses, the legal community, public organizations, and government authorities. Prospects for future research include expanding the analysis of the issues of harmonization of the new regulatory framework in the field of intellectual property, as well as realizing the potential of digitalization in the work of Ukrainian institutions with stakeholders in this area.
