Abstract

The article examines the current state and specific features of the regulatory framework governing the operation of automated information systems used by law enforcement agencies in Ukraine. It substantiates the importance of information technologies and automated information systems for enhancing the effectiveness of preventing, detecting, halting, solving, and investigating criminal offenses, conducting operational-search activities, and providing information and analytical support for law enforcement operations. The study analyzes key regulatory acts governing information relations, the operation of information and communication systems, the protection of information and personal data, and electronic information exchange, as well as the functioning of information resources and systems within the Ministry of Internal Affairs and the National Police of Ukraine. It identifies major issues in legal regulation, specifically the fragmentation and lack of coherence among certain regulatory provisions, and the need to clearly define the powers of information system users and the procedures for accessing, updating, transmitting, storing, and destroying information. Key directions for improving the regulatory and legal framework are proposed, including the systematization and unification of legislation, the definition of unified approaches to the operation of automated information systems, the improvement of access control mechanisms, the strengthening of information protection safeguards, and the establishment of appropriate liability for the unauthorized use of information. The conclusion is drawn that the regulatory framework requires comprehensive improvement, taking into account the rapid development of digital technologies and the needs of law enforcement practice. It is emphasized that effective legal regulation must ensure an optimal balance between the technological efficiency of automated information systems and the principles of legality, information security, proportionality, and respect for human rights and freedoms.
