Abstract

The article examines the legal nature of the Anti-Corruption Strategy as a special instrument for implementing the state anti-corruption policy. It is argued that the Anti-Corruption Strategy cannot be considered exclusively as a strategic planning document, since its functional purpose is to legally consolidate the strategic goals, priorities and main directions of development of state policy in the field of preventing and combating corruption. Given the peculiarities of the content, legal form and implementation mechanism, it is proposed to consider it as a special program legal act that occupies a special place on the border of regulatory and legal regulation and strategic planning. The correlation between the Anti-Corruption Strategy and the State Anti-Corruption Program as strategic and operational levels of implementing the state anti-corruption policy is studied. The mechanisms for coordinating, monitoring and evaluating the implementation of the Anti-Corruption Strategy for 2021–2025 and the State Anti-Corruption Program for 2023–2025 are analyzed. Particular attention is paid to the distinction between monitoring the implementation of individual program measures and assessing the achievement of strategic results. The role of the National Agency for the Prevention of Corruption in coordinating the implementation, monitoring and evaluation of relevant documents is studied, as well as the significance of the National Report on the effectiveness of the implementation of the state anti-corruption policy. An institutional risk associated with the concentration of coordination, monitoring and evaluation functions in one body is identified, which raises the issue of the independence of assessing the effectiveness of the state anti-corruption policy. It is substantiated that the quality of legal regulation in this area depends on the ability of the model established by the legislator to ensure not only the implementation of the envisaged measures, but also the achievement of certain strategic results.
