LEGAL GUARANTEE OF SECURITY ADVANTAGES AT THE STATE BORDER: A STRATEGIC PRIORITY OF THE STATE BORDER SERVICE OF UKRAINE

Abstract

The research aims to develop doctrinal initiatives to support the needs of the State Border Guard Service of Ukraine, as well as to analyze the existing legal and regulatory framework that establishes security imperatives and ensures the sustainability of Ukraine's state border protection system in the context of direct military threats. By strengthening the legal and regulatory mechanisms that underpin security guarantees in the border security sector, the Integrated Border Management concept currently being implemented by the State Border Guard Service of Ukraine will gain additional instruments to maintain an appropriate balance between necessary border control measures and their service-oriented dimension. Ultimately, these efforts will contribute to the development of crosscutting standards within the hierarchy of legal and regulatory acts, aimed at embedding security advantages to ensure the protection and stability of Ukraine’s state border, including during the implementation of border control procedures. Regulatory stability serves as an effective benchmark and a key guarantee of security. Under conditions of unprecedented geopolitical pressure on the state's political leadership, it provides significant reinforcement of national security, particularly in preserving Ukraine’s independence and sovereign rights within its internationally recognized state borders. Alongside the demonstration of security strength by the state’s military and security sector, which includes the bodies and units of the State Border Guard Service of Ukraine, the border agency must possess additional mechanisms and effective legal instruments that guarantee security advantages by regulating permissible actions and authorizing the use of forces and resources aimed at protecting the state territory, as well as safeguarding human and civil rights and freedoms. The State Border Guard Service of Ukraine continues to demonstrate leadership in strengthening Ukraine’s security advantage at its state borders. Further enhancement of military potential, operational and defensive capabilities, and the introduction of technological innovations along the state border already require robust doctrinal support for legislative initiatives. Achieving such timely synergy in itself constitutes a security advantage, as it elevates the interaction between institutional rule-making and legislative development to a qualitatively new level. This issue is of critical importance and requires immediate attention and resolution. Ukraine’s capacity to ensure comprehensive and multidimensional border security, as a priority of its national interests, is a significant asset in the context of Euro-Atlantic cooperation and European integration. One of the key dimensions of this effort is the establishment of a strong legal and regulatory foundation for the further implementation of security-enhancing measures within the border policy framework of the State Border Guard Service of Ukraine. The need to preserve the inviolability of state borders, the constitutional order, and public authority, as well as to ensure Ukraine’s national security and sovereign interests in the face of growing external and internal threats, necessitates comprehensive analysis, scientific inquiry, and the development of concrete proposals aimed at improving the legal and regulatory framework and securing Ukraine’s unequivocal security advantages in the implementation of its border policies.
