CRIMINAL OFFENCES IN THE SPHERE OF LAND RELATIONS: LEGAL MEANS OF COUNTERACTING RAIDING AT AGRO-INDUSTRIAL COMPLEX FACILITIES IN UKRAINE AND WORLDWIDE

The relevance of the study stems from the fact that agricultural land remains the most important and, at the same time, the most vulnerable asset of Ukraine's agro-industrial complex, while raiding attacks on it are becoming increasingly organised and violent under martial law and amid the resumption of the land market. The object of the study is the social relations arising in the process of criminal-law protection of land and agroindustrial facilities against unlawful seizure. The aim of the article is to identify patterns in the criminal-law qualification of raiding attacks on land and property of agricultural producers, to assess the effectiveness of existing criminal-law counteraction measures, and to develop proposals for improving Ukrainian criminal legislation in light of foreign experience. Based on official statistics of the Prosecutor General's Office, the article establishes that the number of registered criminal offences in the sphere of land relations grew from 475 in 2022 to 1260 in 2023, reaching 307 in the first quarter of 2024 alone, indicating a persistent upward trend. It is proven that the current wording of Articles 190, 191, 197-1, 206 and 206-2 of the Criminal Code of Ukraine does not fully cover the typical methods of raiding seizure of land and property of agro-industrial enterprises, including physical seizure of crops and harvest, abuse of lease agreements, and document forgery. Drawing on a comparative-legal analysis of the legislation of Moldova, Kazakhstan and EU member states, as well as a generalisation of international experience in countering the global phenomenon of "land grabbing," the article proposes directions for improving the criminal-law and organisational mechanism for counteracting raiding at Ukraine's agro-industrial facilities. The findings may be used in legislative drafting, law-enforcement practice and further research on the criminallaw protection of land relations.
