STATE POLICY ON THE REGULATION OF BANKING ACTIVITIES IN THE EVENT OF BANKRUPTCY OF A CORPORATE CLIENT OF THE BANK

Abstract

The article is devoted to the research of theoretical and practical bases of state regulation of banking activity in Ukraine in the part of bankruptcy processes of corporate clients. The main directions, necessity and content of domestic banking regulation of relevant processes are determined. The shortcomings of legislative initiatives in the direction of improving banking regulation are analyzed. It has been established that significant shortcomings are granting the liquidator the right to sell the entire property of the enterprise, which went bankrupt in the form of a single property complex; distribution of the funds received by the liquidator between creditors exclusively in the case of sufficiency of funds to meet all the requirements of creditors of one turn; the basic monthly remuneration of the arbitration trustees must be covered additionally at the expense of the funds from the sale of the pledge; payment of the main remuneration to the arbitration trustee “at the expense of creditors’ funds” in the event that the procedure continues after the end of the advanced advances; the independence of the arbitration trustee is leveled.
