ACTUAL PROBLEMS OF PUBLIC ADMINISTRATION IN THE SPHERE OF ENSURING LAW AND ORDER AND SOCIAL SECURITY IN THE CONDITIONS OF MARTIAL LAW

Abstract

The article researched the legal aspects of ensuring law and security order of society in the conditions of martial law, which provides for the protection of the interests, rights and freedoms of a person and citizen vital to society and the individual, and is a priority task of the security forces, other state bodies, local self-government bodies, their officials and the public, who carry out measures in accordance with the legal framework of the country, mainly by prevention and prevention of offenses, as well as by taking appropriate measures to stop violations of the law. It was established that during the period of the special legal regime of martial law in Ukraine, a special legal regime is implemented in Ukraine or in some of its localities in the event of armed aggression or threat of attack, danger to the state independence of Ukraine, its territorial integrity. This means giving the relevant state authorities, military command, military administrations and local self-government bodies the powers necessary to avert the threat, repulse armed aggression and ensure national security, eliminate the threat of danger to the state independence of Ukraine, its territorial integrity, as well as temporary, caused by the threat, restrictions on the constitutional rights and freedoms of a person and a citizen and the rights and legal interests of legal entities with an indication of the period of validity of these restrictions. This means that the rights and freedoms of a person and a citizen, guaranteed by Articles 30-34, 38, 39, 41-44, 53 of the Constitution of Ukraine, cannot be realized in peacetime, which is defined by the provisions of the Law of Ukraine "On the Legal Regime of Martial Law". Namely, in Ukraine or in some of its localities, where martial law has been imposed, the military command together with military administrations (in the case of their formation) can independently or with the involvement of executive authorities, the Council of Ministers of the Autonomous Republic of Crimea, local self-government bodies introduce and carry out within the limits of temporary limitations of the constitutional rights and freedoms of a person and citizen, as well as the rights and legal interests of legal entities, provided for by the decree of the President of Ukraine on the introduction of martial law, a number of measures of the legal regime of martial law.
