THE HEALTH CARE DEVELOPMENT IN UKRAINE IN THE CONTEXT OF INTERNATIONAL OBLIGATIONS AND THE PROPER PROVISION OF NATIONAL INTERESTS

Abstract

The article researches the development of the health care system in Ukraine in the context of the fulfillment of international obligations and the proper provision of national interests in the main international legal acts in the field of health care, the obligation to fulfill which Ukraine has assumed as a subject international law. According to the results of the research, it was established that for the development of health care in Ukraine in the context of international obligations and the proper provision of national interests in public administration, the legislation of Ukraine provides for the conscientious observance of international treaties based on the principle of international law in order to properly provide for national interests, the implementation of goals, tasks and principles of the foreign policy of Ukraine, enshrined in the Constitution of Ukraine and the legislation of Ukraine. Thus, the human right to health protection is enshrined in the provisions of international legal acts ratified by Ukraine, namely: the Convention for the Protection of Human Rights and Fundamental Freedoms (ratified by Law No. 475/97-VR dated 07.17.97); International Covenant on Economic, Social and Cultural Rights (ratified by Decree of the Presidium of the Verkhovna Rada of the Ukrainian SSR N 2148-VIII (2148-08) dated 19.10.73); Convention on the Rights of Persons with Disabilities (ratified by Law No. 1767-VI dated 16.12.2009); Convention on the Rights of the Child (ratified by Resolution of the Verkhovna Rada No. 789-XII dated 27.02.91); The European Social Charter (ratified with declarations by Law No. 137-V dated 14.09.2006, VVR, 2006, N 43, Article 418); The Council of Europe Convention on the counterfeiting of medical products and similar crimes involving threats to public health (ratified by Law No. 4908-VI dated 07.06.2012) and others, including agreements on the provision of medical care, cooperation in the field of health care and medical sciences, etc. At the same time, at the national level (taking into account international content), its own legal mechanism is being formed to ensure the functioning of the health care system, which is the basis for the national health policy and the functioning of the system as a whole.
