INSTITUTIONAL AND LEGAL MECHANISM FOR ENSURING CONSTITUTIONAL RIGHTS AND HUMAN FREEDOMS IN UKRAINE

Abstract

The article researched the set of legal and organizational forms and methods of public administration, aimed at ensuring the institutional and legal mechanism functioning, that guarantee Constitutional rights and human freedoms in Ukraine, which is built in accordance with the state-established legal guarantees of the Constitution of Ukraine and the international law norms, on the basis of which laws are adopted and other normative legal acts, and the content and direction of state activity is determined. As part of the conducted research, it was established, that the institutional and legal mechanism for ensuring the protection of human rights and freedoms, combating crime, maintaining public safety and order corresponds to the foundations of the constitutional system of the state. During martial law, executive authorities act in accordance with the purpose and specifics of their activities, taking into account those restrictions on the rights and freedoms of citizens, as well as the rights and legal interests of legal entities, which are determined in accordance with the Constitution of Ukraine and the Law of Ukraine "On the Legal Regime of Martial Law". In addition, the foundations and principles of national security and defense, the goals and basic principles of state policy, which will guarantee society and every citizen protection from threats, are enshrined in the Law of Ukraine "On National Security of Ukraine", which delimits the powers of state bodies in the spheres of national security and defense, is created the basis for the integration of policies and procedures of state authorities, other state bodies whose functions are related to national security and defense, security forces and defense forces, a system of command, control and coordination of operations of security forces and defense forces is defined, a comprehensive approach to planning in the spheres of national security is introduced of security and defense, thus ensuring democratic civilian control over bodies and formations of the security and defense sector.
