THE INCOMPLETE PROCESS OF CONTRACTUAL AND LEGAL FORMATION OF THE STATE BORDER IS A THREAT TO THE IMPLEMENTATION OF THE POLICY IN THE SECURITY AREA OF THE STATE BORDER OF UKRAINE

Abstract

The article emphasizes that the security of the state border of Ukraine is one of the strategic priorities of the state's national security and defense policy, aimed at improving the mechanisms of policy implementation in the sphere of security of the state border of Ukraine. Undoubtedly, the absence of contractually defined state borders poses a great threat to such an important element of statehood as the international legal title to the sovereign territory, the territorial integrity of the state and the inviolability of its state borders. The main problems that prevent a full response to potential threats to national security at the state border are indicated. The importance and necessity of resolving the problematic issues of the contractual and legal design of the state border of Ukraine with the Russian Federation implies, after the destruction of the Russian occupation army and the victory of Ukraine in this war, the need to conduct an analysis of the content of the legal framework regarding the contractual and legal design of the Ukrainian-Russian state border. It was determined that threats to Ukraine's national security at the Ukrainian-Russian state border include: lack of demarcation of the land section of the Ukrainian-Russian state border and basic interstate treaties and agreements between Ukraine and the Russian Federation, which regulate the procedure for observing the state border regime. The process of contractual and legal registration of the Ukrainian-Russian state border, as well as the work of the Joint Ukrainian-Russian Demarcation Commission, will be resumed only after the complete cessation of the armed aggression of the Russian Federation, the return of control over the Ukrainian-Russian border, and the restoration of constitutional rights in the territories temporarily occupied as a result of the armed aggression of the Russian Federation order It was emphasized that the regulation of processes related to the contractual and legal design of state borders is one of the key priorities in global foreign policy relations. Unsettled issues of contractual and legal registration of the state border of Ukraine pose a serious threat to the implementation of policy in the sphere of security of the state border of Ukraine.
