UPDATES OF THE METHODOLOGY FOR CONDUCTING FORENSIC EXAMINATIONS AND EXPERT STUDIES AS AN IMPORTANT CONDITION FOR THE HIGH QUALITY OF THEIR RESULTS

The stage of protecting rights to intellectual property is no less important than the stage of obtaining such rights. Answers to complex and controversial questions arising at this stage can be solved with the help of expert research. Moreover, for owners of intellectual property rights, it is very important the quality of expert studies conducted at the stage of obtaining rights and their compliance with the results of expert studies or forensic examinations, the need for which may arise at the stage of protection. To fulfill this condition, qualitatively prescribed methods of such studies are required. The number of forensic examinations and expert studies on objects of industrial property law (inventions, utility models, industrial designs and signs for goods and services) in intellectual property is quite significant in the segment of forensic examinations of intellectual property and is constantly growing. On practical examples, it is shown that the methods should contain clearly defined terms and definitions, as well as comply with the current legislation of Ukraine and international treaties, one of the parties to which Ukraine is. The Research Center for Forensic Examination on Intellectual Property Issues is a specialized institution of the Ministry of Justice of Ukraine, which can develop methods for conducting forensic examinations and expert studies in the field of intellectual property. Now the Center is working on the development of updated methods, taking into account the identified shortcomings of existing methods and guidelines, existing international treaties, one of which is Ukraine and the current legislation of Ukraine. So, work has already begun on the GDR «Methodological recommendations for the study of labels registered as marks for goods and services» and «Methodology for the study of trademarks (marks for goods and services).» To improve the conduct of forensic examinations and expert studies related to industrial designs, it is also planned to develop the GDR “Methodology for the Study of Industrial Designs”.
