IMPROVEMENT OF THE NORMALIZATION PROCEDURE SANITARY PROTECTION ZONES IN UKRAINE AS AN INSTRUMENT OF STATE REGULATION OF TOWN-BUILDING ACTIVITIES IN WAR AND POST-WAR PERIODS

Abstract. The purpose of the study is to improve the tools of state regulation of the regulation of sanitary and protective zones for industrial and production facilities during urban planning activities in the territories, including those affected by armed aggression against Ukraine. The scientific novelty consists in the analysis of the current domestic and foreign legal framework for state regulation regarding the regulation of sanitary and protective zones for industrial and production facilities during urban development activities. Conclusions. Proposed priority urgent measures to improve the procedure for standardizing sanitary and protective zones under martial law conditions, which will have economic, sanitary and hygienic, ecological, urban planning, land management effects, namely: the creation of a basic sanitary classification of enterprises, industries and sizes of sanitary and protective zones for them – at the level of the Urban Planning Law of Ukraine, which will regulate the rational use of land and territories for urban planning needs, will contribute to increasing the efficiency of development (restoration of affected territories), the formation of a full-fledged living environment, the creation of favorable conditions for the activities of all economic entities; the creation of a collegial body – the Commission for the review of supporting materials regarding SPZ from representatives of departments (Ministry of Health, Ministry of Infrastructure, Ministry of Environment, National Academy of Medical Sciences of Ukraine (institutes of hygienic profile), etc.); approval of the health and sanitary standard of SPZ for enterprises to be carried out at the level of the Ministry of Health. The vector of further research is determined, which is aimed at an in-depth study of: foreign experience in determining hygienic criteria, which are the basis for establishing the sizes of sanitary protection zones; determination of the possible differentiation (range) of changes in the size (decrease or increase) of sanitary protection zones and implementation in the legislation and practice of domestic urban planning.
