THEORETICAL APPROACHES TO ENSURING GUARANTEES OF CONSTITUTIONAL RIGHTS OF INDIVIDUALS AND CITIZENS UNDER THE LEGAL REGIME OF MARTIAL LAW: A PUBLIC ADMINISTRATION PERSPECTIVE

The article aims to systematize theoretical approaches to ensuring guarantees of constitutional human and civil rights under the legal regime of martial law from the perspective of public administration and governance. Since February 24, 2022, Ukraine has been under conditions of full-scale armed aggression by the russian federation, resulting in the imposition of martial law across the entire territory and significant implications for the exercise of constitutional rights and freedoms. The research employs methods of systemic analysis, comparative legal analysis, generalization, documentary analysis, and formal logical method to examine the interplay between martial law restrictions and public administration mechanisms for rights protection. The study identifies three principal theoretical approaches: the human rights-centered approach (focusing on the inviolability of absolute rights), the security-oriented approach (prioritizing national security with permissible limitations on certain rights), and the balanced approach (proportional combination of security interests and human rights guarantees). The analysis demonstrates that the balanced approach, consistent with international standards including the European Court of Human Rights proportionality test, proves most effective within public administration frameworks. The research reveals that existing public administration mechanisms require substantial improvement to adequately respond to the challenges of rights protection during martial law, particularly in terms of institutional coordination, transparency, and accountability. The study concludes that enhancing public administration mechanisms is essential for achieving an effective balance between national security requirements and the protection of constitutional rights. The findings contribute to the theoretical foundation for developing practical recommendations for public authorities operating under martial law conditions and outline directions for future research in this domain.
