Abstract

The article analyzes that crimes in the activity connected with the transplantation of organs or tissues of a person are determined by certain negative factors, in particular: the presence of “shadow” schemes of work of medical institutions, the absence of an all-Ukrainian bank of organs and tissues, the lack of universal access to medical care, insufficient number of clinics organ transplants, insufficient level of development of domestic clinics for transplantation of organs, shortcomings in the activities of medical institutions, misunderstandings in society about donation, insufficient the development of the principles of humanity in society, as well as the practice of voluntary donations, the lack of a system for encouraging individuals to volunteer donations, transplant tourism (the sale of organs and tissues when traveling abroad), the presence of the “black market” of human organs and tissues, the corruption of health workers , difficult financial situation of persons offering their own bodies for sale, rumors of kidnapping people for the purpose of selling their organs, theft of surgeons during scheduled operations, lack of proper The clarification of the work of medical institutions about the proper donation (donation of organs), insufficient control over the activities of medical institutions by public organizations, the availability of opportunities for the sale of their organs, the uncertainty of people at the fair, medical assistance, the presence of religiously forbidden, inadequate harsh sanctions, criminal laws on the implementation illegal organ transplants, etc. It is substantiated that the list of problems mentioned above will not be solved only by the adoption of new legislation in the field of transplantation activities in Ukraine. First of all, a comprehensive organizational and legal mechanism for the protection and protection of the rights and legitimate interests of the subjects of social relations that arise in the process of preparation and direct conduct of operations with donors should be developed at the state level.
