EXPERT FAILURES IN FORENSIC ENGINEERING IN THE DOMAIN OF HEALTH AND WELLNESS

Formation of a reliable evidentiary basis is the most important aspect to ascertain the truth. A special place among the evidentiary sources belongs to the forensic expert`s findings that make it possible to obtain scientifically substantiated evidences. If the conclusions of the examination are incomplete, unfounded, biased and contradictory, there is a need to appoint and conduct additional forensic examinations. This article explores reasons and consequences of expert failures made in forensic engineering in the domain of health and wellness in investigating industrial safety crimes. The purpose of this work is to analyse and systemise scientific sources and specific forensic expert assessments for averting expert failures during any situational forensic engineering in the area of health and wellness. The failures enable to distinguish expert findings with failures from purposely wrong findings, i.e. an expert`s mistake from a crime against public justice. From this perspective, the said purpose will be implemented through solving the following tasks: defining a concept of failure; classifying expert failures and studying their classification properties; establishing causes of their origin and ways to avert them by giving examples taken from the expert practice. The results of the analysis have shown to eliminate expert failures in the research it is important to improve the set of elements: training, legal framework, technical and methodological support. In the bases of all type of expert failures in forensic engineering in the domain of health and wellness, to one degree or another, lies the insufficient competence of a forensic expert, and in light of advanced technologies increasing the competence of experts, constant study by experts of new methods and achievements in the field of scientific knowledge has the crucial for their prevention in the production of forensic examinations.
