PECULIARITIES OF THE LEGAL TERMINOLOGY OF THE EUROPEAN UNION

Abstract

Abstract. The article is devoted to the study of the legal terminology of the European Union (hereinafter referred to as the EU) and its influence on the national legislation of countries that have entered the EU. European integration processes require adaptation of national legislation to European standards, which leads to the inevitable use of EU legal terminology in national legislation. The main problems with the introduction of new EU legal terms into the legislation of Ukraine are outlined. An analysis of the national mechanism of adaptation of Ukrainian legislation to EU law, i.e. acquis communautaire, was carried out. The system of EU law, which is based on EU legal terminology, is considered. The essence of the concepts “term”, “terminology” was studied and the peculiarities of “legal terminology” were emphasized. Legal terminology has a special character, as it is used in rule-making activity and the quality of normative legal acts depends on it. When a legal term is not understood, it is impossible to apply the norm, hence conflicts and inaccuracies arise. The concept of “EU legal terminology” is proposed. The importance of clarifying the essence of EU legal terminology and taking it into account during translation into the national language is emphasized. There is no universal mechanism for adapting national legislation to the acquis communautaire, as there is no single language in the EU, which complicates the process of rapprochement. Each country chooses the most convenient way of adaptation by creating programs and state authorities. Today, the Center of European and Comparative Law has been established in Ukraine, which reports to the Ministry of Justice of Ukraine. The main task of which is the translation of acquis communautaire norms and the introduction of EU legal terminology into the national legislation of Ukraine. Ways to improve this process are proposed.
