THE INSTITUTE OF APPEALS OF CITIZENS AS A CONSTITUTIONAL MECHANISM FOR THE REALIZATION OF HUMAN RIGHTS AND FREEDOMS IN UKRAINE

The purpose of the research. In the article the main problems of formation of the institute of appeals of citizens to public authorities in Ukraine are considered.
Methodology. The tools of comparative and functional analysis of the state of the scientific base and the connection between the consideration of citizens’ appeals by public authorities and the development of civil society were used.
Scientific novelty. It is substantiated that a certain level of political and legal culture of both citizens and officials is necessary for the effective functioning of the institution of citizens’ appeals. Foreign experience in the functioning and continuous development of civil society, its relations with government agencies, their democratic control, as well as building social institutional capacity is described.
The problems of Ukraine’s activities regarding the functioning of the institution of citizens’ appeals to public authorities are analyzed and itis argued that the relevance of this direction of research is also due to the need for effective regulation of social processes, so that their development does not receive an uncontrollable character, and, in turn, does not lead to undesirable social deformations. Also, in the article the concept-categorical apparatus of the institute of appeals is considered and the main interpretations of the term “treatment” are presented, available in scientific and methodical literature. The actual definition of the notion of circulation as a way by which citizens, in oral or written form, initiate communication with state authorities or officials to satisfy their own interests by resolving government issues of a social nature through the reaction of these bodies or officials to the appeal is given.
Conclusions. It is concluded that the development of the institution of citizens’ appeal takes place within the framework of international legal regulation of human rights and fundamental freedoms and is a constitutional mechanism for the protection of such rights and freedoms, as well as a feedback mechanism for the interaction of the government and society in the processes of public administration.
