ЗАБОРОНА ДИСКРИМІНАЦІЇ ЯК ВАЖЛИВИЙ МІЖНАРОДНИЙ ТА КОНСТИТУЦІЙНИЙ ПРИНЦИП В ГАЛУЗІ ПРАВ ЛЮДИНИ

У статті розкрито заборону дискримінації як важливий міжнародний та конституційний принцип в галузі прав людини. Вказано, що заборона будь-якої дискримінації є невід’ємним елементом правового статусу людини та громадянина. Зазначено, що термін «дискримінація» у загальному плані можна сформулювати як необґрунтоване обмеження у правах та свободах однієї особи або групи осіб порівняно з правами та свободами іншої особи або групи осіб. Звернуто увагу, що в історії загального утвердження прав людини в світі дискримінація вже давно встигла отримати такі змістовні конотації як антагонізм, виключення, вибірковість, відособленість, відмінність, ворожість, вразливість, гноблення, гоніння, заперечення, зверхнє ставлення, ігнорування, меншовартість, нав’язування, насаджування, неприйняття, неприязність, несправедливість, несприйняття, нетерпимість, нетолерантність, нерівноправність, нехтування, обмеженість, перевага, переслідування, пригнічення, придушення, приниження, розрізнення, упередження та утиск. За цього, людство вже встигло також пройти в різних країнах світу такі крайні форми дискримінації як антисемітизм, апартеїд, геноцид, Голокост, ксенофобія, нацизм, расизм, сегрегація, фашизм, шовінізм і це далеко невичерпний перелік. Автором підкреслено, що попри загальносвітове засудження вище наведених крайніх форм дискримінації, страшні та трагічні їхні наслідки, вони і досі продовжують мати місце в сучасному світі через різного роду неоінтерпретації та й далі сіяти ненависть, страх та розбрат між різними групами людей. Зроблено висновок, що встановлення міжнародної заборони дискримінації в окремих сферах суспільного життя не позбавлена трьох основних недоліків, які у свою чергу певним чином підривають довіру до міжнародного правозахисного механізму. По-перше, міжнародна заборона дискримінації в окремих сферах суспільного життя зазвичай здійснюється постфактум, коли людство вже зіткнулося з жахливими наслідками відповідної дискримінації, і лише на підставі цього слідує міжнародна реакція для того щоб не допустити подібних випадків на майбутнє. По-друге, реагування міжнародної спільноти на існуючі факти дискримінації в окремих сферах суспільного життя є доволі повільним, громіздким та забюрократизованим процесом, унаслідок чого для реального втілення в життя тієї чи іншої міжнародної заборони дискримінації в окремих сферах суспільного життя знадобляться десятки років, що у розрізі людського життя є доволі тривалим строком. По-третє, у міжнародній практиці мають місце чисельні випадки, коли перешкодою до встановлення міжнародної заборони дискримінації в окремих сферах суспільного життя є геополітичні інтереси провідних держав світу, які в ієрархії міжнародної політики стоять вище загальнолюдських цінностей, у результаті чого реальні дії обмежуються лише загальною декларативною «глибокою стурбованістю» щодо тих чи інших проявів дискримінації, які слід невідкладно усунути в світі.
