Abstract

The article describes theoretical basis for the sustainability of the decentralization process in Ukraine, the development of new institutions at the regional level in the context of European managerial experience in modern conditions of reforming of public administration system in Ukraine. Theoretical aspects of the new administrative-territorial structure of Ukraine, which is enshrined in the Constitution. Choosing the European direction of development and move away from the dogmas of the post-Soviet period require independent Ukraine the development of an effective model of public management and administration, resulting in a change of existing institutions and creating new ones. The development of the modern Ukraine local self-government of the principles of ubiquity. The introduction of a new institution of prefect just due to the contemporary local government reform and territorial power organization in Ukraine. The purpose of the article. Legal and institutional aspects of public administration, including in-tutu local government, researched by the following scientists: V. Averyanov, V. Bakumenko, V. Vorotin, V. Groisman, O. Koval, V. Kuybida, A. Tkachuk, Y. Shemshuchenko and others. Despite the significant number of scientific papers about the activities of state Executive authorities and local self-government formation and their relationship, the specified topic was not the subject of a separate study, which determined the topicality of this article. The aim of this work is a theoretical study, comparative analysis of European experience of local self-government development, substantiation and development of practical recommendations on formation and implementation of the reform of local governance based on the analysis of the priorities of the Government regarding amendments to the Constitution of local development, which was presented in October 2019. Scientific novelty. Is to clarify the essence of the basic concepts of the research, in particular the «decentralization of power», «administrativeterritorial system», «territorial management» and spustenia study the aspect of building local self-government based on the principles of ubiquity. In the work to reveal the functions and features of the organization of activities of local governments after making changes to the Constitution of Ukraine in part of local communities, which should cover all of Ukraine. It is proved that after the indicated constitutional changes there will be more territories that were not under the jurisdiction of local authorities. Analyzed the functions and powers of local state administrations, and conclusions about their further status and advisability of existence. Conclusions. The study suggests that the control of European territories in countries with different development of market relations took place with the strengthening of centralization, and with notable decentralization of public authorities; consideration of the European experience of building local government shows the tendency to the use of the mechanism of subsidiarity. Which is that the problem is solved where it originated. Directly provided on a most close level to the people. After the reform process, the system must operate: communities, government, and the state control. Gradual decrease of the function of state management in the field in terms of weakening its role of a direct impact on local government, leaving control over the observance of legality. With the use of effective regulatory practice should be developed and effective system of management of territories that is constantly being improved in terms of social change and improving the quality of life of the European population in Ukraine.
