ENSURING CONSTITUTIONAL AND LEGAL REGULATION OF THE HUMAN RIGHT TO MEDICAL CARE WITH THE APPLICATION OF TRANSPLANTATION

Abstract

The article examines the constitutional and legal regulation of the human right to medical care with the use of transplantation. The study is devoted to the systematization of regulations governing relations arising from the implementation of the human right to medical care through transplantation, a list of major international and regional regulations governing the transplantation of human anatomical materials. Life and health are fundamental benefits and one of the highest social values of man. Without this right, all other rights have no value and significance. The social significance of medical care with the use of transplantation is determined by the function of saving lives, the implementation of which requires proper legal regulation. Therefore, the priority of health care and medical care among other spheres of society is unconditional and defined in Ukrainian legislation. Respect for human rights is a key national idea of all democracies around the world. The study of ensuring the constitutional and legal regulation of the human right to medical care using transplantation in Ukraine is important for the further development of legislation in the field of transplantation, improving guarantees of rights using transplantation in Ukraine, realization of the right to medical care using transplantation and its protection. also to improve the practical activities of authorized entities in the relevant field. The normative base of the study is represented by national and foreign legislation concerning the provision of constitutional and legal regulation of the human right to medical care with the use of transplantation of anatomical materials to humans and international legal instruments.
