KEY ASPECTS OF INTERNATIONAL LEGAL RESPONSIBILITY OF STATES HOSTING COMPANIES ENGAGED IN PRIVATE MILITARY AND SECURITY ACTIVITIES

The article examines the main aspects of the international legal responsibility of states that host companies engaged in private military and security activities. It is determined that in order to protect human rights, it is necessary to provide for the host state's obligation to take the measures necessary to give effect to obligations in the field of protecting such rights. A comprehensive analysis of the Montreux Document, which defines host states as states of territorial jurisdiction, is conducted, recommending that measures be taken to stop violations of international humanitarian law and to ensure the dissemination of information about it. In order to control the activities of companies engaged in private military and security activities, the Montreux Document proposes the creation of a special state body or the empowerment of another existing body to exercise such control. It also recommends taking measures to compel companies engaged in military and security activities to comply with national law, in particular by establishing legal liability for unlawful acts. It is specified that the host state is responsible for the activities of companies engaged in private military and security activities on its territory. It is obliged to monitor, within its jurisdiction, compliance with human rights by employees of companies engaged in private military and security activities and, in the event of violations, to ensure effective investigation and punishment.
