PECULIARITIES OF THE LEGAL REGIME OF WELL-KNOWN TRADEMARKS IN THE CONTEXT OF EUROPEAN INTEGRATION PROCESSES

The article is devoted to the study of the specific features of the legal regime of well-known trademarks in Ukraine in light of the contemporary transformations of trademark legislation. The international legal foundations for the protection of well-known trademarks are examined, as well as the particularities of their implementation in the national legislation of Ukraine. The existing model for recognizing a trademark as well-known in administrative and judicial proceedings is analyzed, taking into account contemporary judicial practice. Particular attention is paid to the problematic aspects of the functioning of the institution of well-known trademarks in the context of the approximation of national legislation to the standards of the European Union, namely in connection with the development of a new law in the field of trademarks and, consequently, the introduction of new concepts, procedures and approaches. The article highlights potential legal and procedural uncertainties that may arise as a result of the transformation of approaches to the legal protection of well-known trademarks and outlines the risks for their right holders in the course of further legislative reform.
