STRENGTHENING THE INSTITUTIONAL CAPACITY OF THE PRESIDENT OF UKRAINE IN THE FIELD OF NATIONAL SECURITY AND DEFENSE IN THE LIGHT OF FOREIGN MODELS OF STATE MANAGEMENT OF NATIONAL SECURITY

Abstract

Abstract. The third year of full-scale armed Russian aggression against Ukraine highlighted or exacerbated a number of problems of an institutional nature in the field of state management in the sphere of national security and defense. In particular, this applies to the President of Ukraine as an institutional subject, who, according to clause 17, part 1, article 106 of the Constitution of Ukraine, is the Supreme Commander-in- Chief of the Armed Forces of Ukraine; appoints to positions and dismisses from positions above the command of the Armed Forces of Ukraine, other military formations; exercises leadership in the spheres of national security and defense of the state. Given the colossal scope of powers of the main subject of state administration in the field of national security and defense, which is the head of state, the cornerstone condition for the effectiveness of state administration becomes especially acute: the presence of the necessary competence of the subject of administration. The analysis of foreign models of state management of national security proved that the prevention of dilettantism and unprofessionalism of the head of state in this area, which can lead to catastrophic consequences for the entire country, is ensured in a number of countries by the legislative regulation of qualification requirements for a candidate for the country’s main position. Based on this analysis, the article proposes to supplement Part 2 of Article 103 of the Constitution of Ukraine with a requirement for a candidate for the position of President of Ukraine to undergo military service or basic military training, by wording it as follows: A citizen of Ukraine who has reached the age of thirty-five can be elected President of Ukraine, has the right vote, has lived in Ukraine for the last ten years before the election day and speaks the state language, has completed basic military training or military service in the ranks of the Armed Forces of Ukraine or the Armed Forces of NATO member countries.
