Abstract

The article states that land relations in Ukraine in recent decades can be confidently considered one of the most corrupt areas of public administration. At the same time, the system of state bodies of land resources, within which a wide range of powers is concentrated on land management, land management and land valuation, maintaining the State Land Cadastre, state control over land use and protection, regulation of topographic and geodetic activities, etc., should be considered extremely attractive organizational and management tool for building a centralized vertical for the removal of corruption rents in the procedures of free privatization of land, issuance of permits, change the purpose of land, land cadastre, etc. It is substantiated that today in Ukraine there are 11215 territorial communities (both united and not united). The boundaries of these communities, which include settlements and the adjacent territory outside the settlements, were determined in the 90s of the last century in accordance with the projects of formation of territories of village and settlement councils. These boundaries are now used to pay for land (land tax and rent for state and communal lands), as well as to define community boundaries in the process of merging them. However, information on these boundaries is not available in the State Land Cadastre as official data. In the cadastre, these boundaries are presented as the boundaries of cadastral zones and quarters and, in many cases, are defined quite incorrectly (often they cross the boundaries of existing land plots, or do not coincide with those boundaries traditionally considered «own» by local governments and tax authorities) . Another huge problem is that there is no procedure for establishing and changing these boundaries in the legislation of Ukraine, as the Constitution of Ukraine and the Land Code of Ukraine regulate only the procedure for establishing and changing the boundaries of settlements and districts.
